Municipal control as a tool for development of the territory
On the third day of the Gaidar Forum, on January 17, a discussion took place devoted to the review of control and supervisory activities as one of the tools for business development. Ekaterina Shugrina, Leading Research Fellow at the Institute of Management and Regional Development, RANEPA, Anna Madyarova, Leading Advisor to the Office of the State Duma Committee on Federal System and Local Self-Government Issues, Oleg Kozhevnikov, Professor of the Constitutional Law Department, the Urals State Law University, Teodor Maryutin, Deputy Mayor of Khanty-Mansiysk, Igor Norenkov, Minister of Economic Development and Investments of the Nizhny Novgorod Region, Andrey Podgorbunskikh, Deputy Mayor of Omsk, Director of Legal Support and Municipal Service, Maxim Rymar, Minister of State Administration, Information Technologies and Communications of the Moscow Region, and Sergey Sakharov, Mayor of Suzdal, took part in the open dialogue.
Relying on her own research, Ekatherinf Shugrina identified the main topics of discussion: what problems exist in the field of municipal control and what are the development prospects in this area.
“The problem lies in the lack of a clear idea of what the municipal control should be,” said Anna Madiyarova. “There is no elective response to violations found in the process of municipal control, and there is no understanding of responsibility for violation of municipal legal acts.” The expert noted that currently the State Duma considers a number of bills that provide for an increase in the powers of local authorities and, in particular, the transformation of land control.
Andrei Podgorbunskikh shared his opinion on how municipal control is exercised. The expert believes that first of all it is necessary to pay attention to the improvement of land control as a separate type, since the forces, means, and measures of influence existing at the moment with respect to unfair land users are not enough.
Teodor Maryutin listed the types of control that are of the highest priority: land and forest control, control over the integrity of roads and compliance with the rules of urban improvement on the territory of the municipality. “The factor of public participation in the implementation of municipal control is also important, since this mechanism allows to fully control the situation,” the expert noted.
Igor Norenkov drew attention to the importance and relevance of the discussion topic. “Municipal control is necessary, since federal and regional resources are not always enough to carry out quality control over the implementation of the norms of legislation,” the minister explained.
Summing up the discussion, Oleg Kozhevnikov noted that when forming a model of municipal control, it is necessary first of all to formulate most clearly and understandably laws governing this area. The panelists came to the conclusion that the type-based composition of municipal control should take into account the specifics of the territorial structure of municipalities, and also be limited to requirements that are established only at the level of municipal legal acts.
