Russian Jurisdiction Gains Competitiveness (VIDEO)
The issues of quality of the regulations in Russia were examined within the framework of the X Gaidar Forum, and the prospects for developing the competitiveness of national jurisdiction were also assessed. On January 15, a panel discussion “Russian jurisdiction: factors of attractiveness and competitiveness” took place.
Vladimir Gruzdev, Chairman of the Board of the Association of Lawyers of Russia, opened the discussion. He noted that this section was working at the Gaidar Forum for the first time, and thanked the participants for their interest in the topic of the event.
One of the key points of the discussion was the speech of Igor Bartsits, Director of the Institute of Public Administration and Civil Service, RANEPA. He presented the report “National jurisdiction: a course on the competitiveness of the legal system of Russia”, which was prepared by RANEPA together with the Russian Bar Association. The report raised the problems of jurisdiction and the unity of law-enforcement practice, addressed the issues of global competition of legal systems and transition from distributive to procedural justice. “If a person chooses a domestic university to study and is treated in a domestic clinic, then this is a quality state. If a person prefers a foreign university and a foreign hospital, then there is something to think about. We develop this thesis further and encourage to study, to receive treatment and to sue in the Motherland!”– Igor Bartsits said. The report will be published on the websites of RANEPA and the Russian Bar Association.
Boris Titov, authorized by the President of the Russian Federation on the rights of entrepreneurs, noted that jurisdiction has very specific concepts and assessments for entrepreneurs, such as transparency and professionalism of the judicial system, not burdening administrative regulation, which should help the entrepreneur, and not create additional problems for him, if he does business in accordance with the law. He also stressed that criminal law should not be used to select a business and violate the rights of an entrepreneur. “Jurisdiction is jurisdiction, and investments depend not only on the legal system, but also on the economic part. No legal system will attract investors if it is unprofitable for them to work and to make profit in this country,” – Boris Titov said.
During the discussion, Savva Shipov, Deputy Minister of Economic Development of the Russian Federation, noted that Russia has not developed a tool for issuing clarifications on how the legislation should be applied: the control body does not have the right to give explanations. It can be given only by the body that adopted the relevant regulatory legal act. “This is a big problem, because such explanations are the guidelines on which the interaction of business and government should be built. It should be clear to business how to act,” the Deputy Minister of Economic Development of Russia noted. He also told that a draft law was prepared to create regulatory sandboxes, when the new regulation does not apply to all fields, but is applied in individual public relations in a local area. It has to be discussed and improved with other authorities.
Denis Novak, Deputy Minister of Justice of the Russian Federation, stressed the importance of changes in corporate legislation and contract law, highlighting consolidation of the ideology of the disposition of regulated relations.
At the end of the discussion Konstantin Chuychenko, Deputy Prime Minister of the Russian Federation, spoke. He noted that the problem of attractiveness of the Russian jurisdiction contains a lot of factors. Among them, he noted first of all the improvement of control and supervisory activities and corporate governance.
